Each year thousands of innocent people are the victims of attacks by aggressive dogs, including people living in Rochester MN. These attacks can cause serious scarring, pain and medical bills and other complications such as infection. It is the obligation of everyone who owns or cares for a dog to control the animal and keep it from harming others.
Minnesota Law on Dog Bite Injuries
Under Minnesota Statute § 347.22, it states, “[i]f a dog, without provocation, attacks or injures any person who is acting peaceably in any place where the person may lawfully be, the owner of the dog is liable in damages to the person so attacked or injured to the full amount of the injury sustained.” Unless the person who was bitten by the dog was provoking the dog, the owner of the animal will be liable for the injuries that were caused by the attack. Minnesota law protects people even in circumstances where they are not actually bitten, but where they are harmed by a dog jumping or chasing them.
Claims Involving Children
If a child is injured as a result of a dog bite, the parent or guardian may seek damages against the defendant on the child’s behalf. Any money that is recovered on behalf of the child is held in trust under the court’s supervision and earns interest until the child is 18 years of age.
